1. Agreement to Terms
By accessing or using the Stacks application and website (“Service”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
2. Description of Service
Stacks is a Swiss self-custody Bitcoin wallet application. By default, Stacks does not hold, manage, or have access to your private keys or digital assets, and you are solely responsible for the security and management of your private keys and recovery phrases. Stacks also offers an optional custody service for Bitcoin (the “Custody Service”) for users who choose not to self-custody it. Physical gold is a physical asset and cannot be self-custodied through Stacks; it is only available under the Custody Service. Assets enrolled in the Custody Service are held on your behalf by Stacks and/or its regulated custody and vaulting partners under separate custody terms.
3. Self-Custody vs. Custody Service
Bitcoin can be held either in self-custody or under the Custody Service. Physical gold, being a physical asset, cannot be self-custodied through Stacks and is only available under the Custody Service.
When you self-custody your Bitcoin, Stacks operates on a non-custodial basis. This means:
- You are the sole owner and controller of your private keys.
- Stacks cannot recover lost private keys or recovery phrases.
- Stacks cannot reverse, cancel, or refund transactions.
- You bear full responsibility for safeguarding your credentials.
When Bitcoin or gold is held under the Custody Service, Stacks and/or its custody partners hold and safeguard the enrolled assets on your behalf. Custody Service assets are recorded to your account, segregated from Stacks' own assets, and subject to the specific custody terms presented to you at enrollment. Enrolling your Bitcoin in the Custody Service does not affect any Bitcoin you continue to hold in self-custody.
4. Buying, Selling & On-Chain Transaction Records
Stacks may integrate with third-party partners for the purchase and sale of Bitcoin and gold. These transactions are facilitated by independent, regulated partners and are subject to their own terms and conditions. Stacks is not responsible for the actions or omissions of third-party providers.
For transparency and auditability, Stacks may cryptographically anchor a record of in-app trade transactions on the Bitcoin blockchain. What is anchored is a cryptographic hash (fingerprint) of transaction data, not your personal information — the underlying transaction details are not made public.
5. Eligibility
You must be at least 18 years old and legally permitted to use digital asset and precious metal services in your jurisdiction to use Stacks.
6. Risk Disclosure
Digital assets and precious metals are subject to significant price volatility and other risks. The value of Bitcoin and gold can fluctuate dramatically. You should not use Stacks with funds or assets you cannot afford to lose. Nothing on this platform constitutes financial, investment, or legal advice.
7. Limitation of Liability
To the fullest extent permitted by law, Stacks and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or assets arising from your use of the Service.
8. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of Switzerland, excluding its conflict-of-law rules. The exclusive place of jurisdiction is [Registered Office / Canton], Switzerland, to the extent permitted by mandatory law.
